LEGAL AND ETHICAL ISSUES IN THE HEALTHCARE DELIVERY SYSTEM
A CASE STUDY OF PROFESSIONAL MALPRACTICE
Legal Aspects of the Case
Laws are developed for the benefit of the society. Its enactment is to protect those individuals who require protection and outline the consequences and penalties for those who break them. In healthcare, there are laws that affect patients and providers alike. However, the law illustrates the duty we have to care for each other and if we fail to do, injuring someone in the process, there will be a penalty (Pozgar, 2013). It is especially imminent for providers to adhere to the law – state, federal or organizational – for the betterment of the patients they care for.
Healthcare providers do not set out with the malicious intent to harm those being cared for. Unfortunately, situations arise where individuals are hurt, or worst, die from the negligence of their providers. The laws broken included nurses not adhering to standards required for their skills, going against hospital policies, and lack of proper documentation
